Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hividai Technologies ("Hividai," "we," "us," or "our") governing your access to and use of the Hividai website at hividai.com, all associated sub-domains, and the Hividai mobile applications for iOS and Android (collectively, the "Services").

By accessing or using any part of the Services, you confirm that you are at least 16 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you must immediately cease using the Services.

If you are using the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" and "your" shall refer to that entity.

2. Description of Services

Hividai provides artificial intelligence-powered media enhancement tools, including:

• AI Image Enhancer — Automatically improves image quality, sharpness, and clarity using deep learning models.
• AI Image Upscaler — Increases image resolution up to 4× using super-resolution neural networks (ESRGAN-family).
• Unblur Image Tool — Corrects motion blur, focus blur, and compression artifacts using AI deconvolution.
• AI Video Upscaler — Enhances and upscales video content, available via the mobile app with full 4K/60fps capabilities.

The web-based tools are available without account registration for standard use. The mobile Pro application offers advanced features including 4K video upscaling, batch processing, and offline processing, subject to applicable subscription fees.

Hividai reserves the right to modify, suspend, or discontinue any feature or service at any time, with reasonable advance notice where practicable.

3. Your Content & Ownership

You represent and warrant that:

• You own, or have all necessary licenses, permissions, rights, and consents to use and submit the content you upload.
• Your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
• Your content complies with all applicable laws in your jurisdiction and the jurisdictions where it may be accessed.

Hividai accepts no responsibility for any content uploaded by users and expressly disclaims all liability arising from user-submitted content. You are solely responsible for the legality, reliability, integrity, and quality of all content you submit.

4. Temporary Processing License

Scope of License

The processing license you grant Hividai is strictly limited to:

• Transmitting your uploaded file to our AI processing infrastructure.
• Running the file through our AI enhancement model to generate the output.
• Temporarily storing the input and output files on our servers while you complete your session and download your result.

Automatic Revocation

This processing license is automatically and permanently revoked upon deletion of your uploaded files from our servers. All user-uploaded files — both input and processed output — are automatically deleted from Hividai's servers within twenty-four (24) hours of upload. This deletion is permanent and irreversible.

No AI Training Use

Hividai does not and will not use your uploaded content to train, fine-tune, test, validate, benchmark, or otherwise develop any AI or machine learning model, whether operated by Hividai or any third party. This restriction is unconditional and applies regardless of whether your uploaded content is identifiable or anonymized. Our AI models are trained exclusively on licensed datasets and publicly available academic benchmarks.

5. Acceptable Use Policy

Hividai's Services are provided for legitimate personal, professional, and commercial media enhancement purposes. You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Services.

You agree that you will not:

• Use the Services in any way that violates any applicable local, national, or international law or regulation.
• Upload content for any purpose other than the intended AI enhancement use case.
• Attempt to reverse engineer, decompile, or otherwise extract the underlying AI model weights, architecture, or training data from the Service.
• Use automated scripts, bots, scrapers, or similar tools to access the Services beyond what is permitted by our API terms.
• Overload, abuse, or attempt to interfere with the security or performance of our servers or infrastructure.
• Misrepresent Hividai-enhanced content as original unmodified media in any context where such misrepresentation could cause harm.
• Use the Services to process content belonging to others without their explicit consent.

6. Prohibited Content

You are strictly prohibited from uploading, processing, or using Hividai's Services in connection with any of the following:

Illegal Content

• Any content that is illegal under the laws of your jurisdiction or the jurisdiction of Hividai Technologies.
• Content that facilitates or promotes criminal activity, terrorism, or violence.
• Content subject to court orders or injunctions restricting distribution.

Child Safety

• Any content that depicts, suggests, or could be used to produce child sexual abuse material (CSAM) or content that sexualizes minors in any way.
• Hividai operates a zero-tolerance policy for child safety violations. All such instances will be immediately reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement authorities.

Non-Consensual Intimate Imagery (NCII)

• Uploading, enhancing, or processing intimate or sexual images of any real person without their explicit and documented consent.
• Using the service to enhance or restore non-consensual intimate imagery in any form.

Synthetic Media & Deepfakes

• Using Hividai's Services to enhance, upscale, or improve the quality of any AI-generated synthetic media (deepfakes) that depicts a real person in a false, misleading, defamatory, or non-consensual manner.
• Using enhanced output in the production of synthetic media designed to deceive viewers into believing the content is authentic, particularly for political manipulation, financial fraud, or defamation.

NSFW & Explicit Content

• Uploading or processing sexually explicit, pornographic, or obscene material of any kind, including graphic depictions of sexual acts regardless of whether the subjects are adults.
• This restriction applies to all plans including paid and API users. There are no "adult content" tiers or exemptions available on the Hividai platform.

Hate Speech & Harassment

• Content that promotes, glorifies, or incites hatred, discrimination, or violence against individuals or groups based on protected characteristics including race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Content created for the purpose of harassing, threatening, or intimidating a specific individual.

7. Accounts & Subscriptions

Web Tool (No Account Required)

Standard web tool features are available without creating an account. Usage may be subject to rate limits to ensure fair access for all users. Hividai reserves the right to implement or modify rate limits at any time.

Pro Mobile App Subscription

The Hividai Pro mobile application is available on a subscription basis through the Apple App Store and Google Play Store. Subscription pricing, billing cycles, and features are displayed in the respective app stores. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refund requests are handled in accordance with the refund policies of the Apple App Store and Google Play Store respectively. Hividai does not process refunds directly for in-app purchases.

API Access

Business API access is provided under a separate API agreement. API users are subject to these Terms of Service in addition to the specific terms outlined in their API agreement. API users are solely responsible for ensuring that all end-user content processed through the API complies with the Prohibited Content policy outlined in Section 6.

8. Service Availability

Hividai strives to provide continuous, reliable service but does not guarantee 100% uptime. The Services are provided on an "as available" basis. Scheduled maintenance windows will be communicated in advance where possible. We reserve the right to suspend or restrict access to the Services for maintenance, security incidents, or abuse prevention without prior notice.

9. Disclaimers & Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HIVIDAI DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

AI enhancement results are probabilistic and inherently variable. Hividai makes no guarantee regarding the specific quality, accuracy, or suitability of enhancement outputs for any particular purpose. Users are solely responsible for evaluating the suitability of enhancement results before use in any commercial, professional, or personal context.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIVIDAI TECHNOLOGIES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, HIVIDAI'S LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless Hividai Technologies and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any claim that your uploaded content caused damage to a third party.

12. Termination

Hividai reserves the right to suspend or terminate your access to the Services immediately, without prior notice, at our sole discretion, if we determine that you have violated these Terms — particularly the Prohibited Content policy in Section 6. Upon termination, your right to use the Services ceases immediately. Any uploaded files not yet deleted will be queued for immediate permanent deletion. Termination does not affect any accrued legal rights or obligations prior to the date of termination.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction of incorporation of Hividai Technologies, without regard to conflict of law provisions. Any disputes arising from these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the courts in Hividai's place of incorporation, subject to any mandatory consumer protection provisions applicable in your jurisdiction.

14. Changes to These Terms

Hividai reserves the right to modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via a prominent notice on our website or, where applicable, by email notification. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services before the effective date of the changes.

The current effective date and version number of these Terms are displayed at the top of this page. We recommend bookmarking this page and reviewing it periodically.
